Terms and Conditions of Use for Media Engage
These Terms and Conditions of Use (the “Terms of Use”) apply to the Media Engage website located at www.mediaengage.com and all associated sites linked to www.mediaengage.com by Media Engage, its subsidiaries, and affiliates, including Media Engage sites around the world (collectively, the “Site”). The Site is the property of Media Engage and its licensors.
BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.
CLIENT RESPONSIBILITY FOR PROPERTY
Please ensure the property is prepared for photography/videography according to the guidelines on www.mediaengage.com. If the client or agent is not present at the shoot, Media Engage will photograph the property “as is” and will not be responsible for clutter or unwanted items in the picture.If the client or agent is present they may reserve the right to verbally cancel on scene if these guidelines have not been followed and a $50 late cancellation fee will apply. In the absence of the client or agent, Media Engage reserves the right to determine if the shoot can proceed based on weather conditions. In the case of adverse weather conditions, the photographer may need to return to complete the assignment, and the client will not be responsible for additional expenses due to weather.
SAFETY
If Media Engage’s photographers deem the home and/or property unsafe in any way for the photographer or their equipment, the photographer has the right to leave the scene immediately, regardless of progress.
COMMUNICATIONS
Media Engage may communicate with clients through telephone, email, text, or by posting notices and messages on social media platforms, which clients agree to. Clients also agree to allow Media Engage to display their products, property information, and agent information on certain Media Engage-owned websites and/or any social media.
MATERIAL STORAGE
Media Engage will retain ordered material on file for up to 6 months after the shoot date. Media Engage is not responsible for material deleted earlier through no fault of its own.
DELIVERY
Media Engage will make every effort to deliver all edited images to the client’s Media Engage account by 12:00 p.m. on the day after the photo shoot. If unable to do so, the images will be delivered within a reasonable time the next day.
Video projects will be delivered in a timeline agreed upon between the client and the media engage representative based on the project.
CANCELLATION POLICY
A late cancellation charge of $50 will apply to the client’s account in the event of a cancellation, only if the photographer has reached the property and cannot finish the project.
COPYRIGHT
All Media Engage products displayed on the Internet, including text, photographs, images, graphics, computer code, sound, music, art, “look and feel,” and intellectual property, are the sole property of Media Engage. Clients are granted unlimited use of the products for their own marketing purposes but may not resell, share, or copy any of Media Engage’s products to a third party. Continued use of Media Engage’s products in violation of this agreement may result in legal action.
COMPLAINTS
In the event of dissatisfaction with the delivered product, clients should contact Media Engage within 48 hours of receiving the product. Media Engage retains the sole discretion to determine if the quality of the delivered product meets its standards, and if revisions are necessary. If not, remedial services may be subject to additional charges.
